JATIMTIMES - Pemerintah Kota (Pemkot) Malang mulai memperketat penegakan aturan terhadap kios dan los pasar yang tidak aktif digunakan berjualan. Langkah itu dilakukan melalui penerapan disiplin Peraturan Daerah Nomor 12 Tahun 2004 di seluruh pasar tradisional yang berada di bawah pengawasan Dinas Koperasi, Perindustrian dan Perdagangan (Diskopindag) Kota Malang.
Kepala Bidang (Kabid) Perdagangan Diskopindag Kota Malang, Luh Putu Eka, menegaskan pihaknya telah mulai melakukan penempelan tanda peringatan di kios-kios yang tidak aktif digunakan pedagang.

"Kalau terkait penerapan perda, itu sebenarnya kita sudah mulai berjalan. Ini, seperti ini ya ininya yang saya tempel di semua pasar. Ini bisa dicek, sudah saya tempel di pasar-pasar yang tidak aktif. Karena memang kita mau menegakkan perda ini," ujarnya.
Menurutnya, penertiban tersebut dilakukan hampir di seluruh pasar di Kota Malang. Namun demikian, Diskopindag masih memberikan ruang bagi pedagang untuk kembali aktif berjualan sebelum dilakukan tindakan lebih lanjut.
"Artinya, itu sudah kita tugaskan kepala pasar untuk menempel. Tapi kita tidak yang saklek. Kita masih memberikan ruang. Barangkali mereka mau jualan lagi," jelasnya.
Ia mencontohkan, di Pasar Kasin terdapat pedagang yang kembali membuka kiosnya setelah mendapat peringatan dari pengelola pasar. "Nah, contohnya di Pasar Kasin, ada dua yang sudah buka lagi yang dulunya enggak aktif," katanya.
Penertiban itu juga mulai diterapkan di kawasan Pasar Induk Gadang yang saat ini masih dalam proses penataan dan pembangunan untuk penataan jalan. Diskopindag memastikan proses verifikasi pedagang masih terus berlangsung sembari menunggu penyelesaian pembangunan sisi barat pasar yang ditarget rampung Juni 2026.
"Yang pasti sekarang tim kami sedang memverifikasi. Kan ini prosesnya belum selesai. Proses verifikasi pedagang di pasar induk itu masih berjalan, masih berproses. Karena apa? Karena pembangunan kan juga belum selesai," terang wanita yang akrab disapa Eka itu.
Dalam proses verifikasi tersebut, Diskopindag menegaskan hanya pedagang aktif yang rutin berjualan dan membayar retribusi harian yang akan diprioritaskan untuk diakomodasi.
"Jadi, memang yang kita akomodir adalah pedagang yang aktif berjualan dan membayar retribusi harian, kan itu yang menjadi kriteria kalau dia aktif," tegasnya.
Ia menyebut jumlah pedagang aktif yang tercatat saat ini mencapai sekitar seribu lebih pedagang. Data detailnya berada di masing-masing mantri dan kepala pasar yang setiap hari melakukan penarikan retribusi.

Selain penertiban kios tidak aktif, Diskopindag juga menyoroti praktik jual beli kios atau bedak pasar yang masih terjadi di lapangan. Meski demikian, Eka menegaskan secara regulasi praktik jual beli tersebut tidak dibenarkan.
"Nah, kalau jual beli, saya seringkali menyampaikan secara regulasi kan tidak boleh. Jelas kan? Itu mereka hanya punya izin menempati berdasarkan buku yang dipegang itu," ujarnya.
Namun, Diskopindag mengakui proses transaksi antar pedagang kerap terjadi di luar pantauan pemerintah. Karena itu, pihaknya hanya berfokus pada pemenuhan administrasi dan aktivitas perdagangan di lapangan.
"Karena kami yang kami butuhkan adalah secara administrasi sudah terpenuhi dan mereka kemudian aktif berjualan, kios los yang kita berikan itu dimanfaatkan," katanya.
Terkait proses alih nama kepemilikan kios atau los, Diskopindag menyebut mekanisme tersebut diperbolehkan selama seluruh persyaratan administrasi dipenuhi. Pengalihan tidak harus dilakukan kepada anggota keluarga dan bisa diberikan kepada pihak lain. "Tergantung dari pemilik pertamanya," ujar Eka.
Ia menambahkan, syarat utama alih nama adalah adanya berita acara penyerahan kios kepada Pemkot Malang, dilengkapi dokumen identitas hingga bukti aktivitas berjualan dari pemohon baru.
Meski tidak menelusuri latar belakang transaksi secara mendalam, Diskopindag memastikan kepala pasar wajib mengetahui keberadaan dan aktivitas pedagang yang mengajukan alih nama. "Jangan sampai kios los itu ditelantarkan," pungkasnya.
