JATIMTIMES - Sengketa warisan tanah masih menjadi persoalan yang kerap muncul di tengah masyarakat. Tidak sedikit konflik keluarga terjadi karena minimnya pemahaman mengenai siapa saja yang sebenarnya berhak menerima harta peninggalan, khususnya berupa tanah dan bangunan.

Padahal, status ahli waris menjadi hal penting yang harus dipastikan sebelum mengurus balik nama sertifikat tanah di kantor pertanahan. Kesalahan dalam menentukan pihak yang berhak menerima warisan bisa memicu perselisihan berkepanjangan hingga berujung pada proses hukum.

Di Indonesia, ketentuan mengenai ahli waris mengacu pada beberapa sistem hukum yang berlaku, yakni hukum adat, hukum Islam, dan Kitab Undang-Undang Hukum Perdata (KUH Perdata). Karena itu, masyarakat perlu memahami aturan tersebut agar proses peralihan hak atas tanah dapat berjalan lancar.

Lantas, siapa saja yang berhak menerima warisan tanah menurut ketentuan hukum di Indonesia?

1. Suami atau Istri yang Sah

Pasangan yang masih terikat dalam perkawinan yang sah ketika pewaris meninggal dunia termasuk pihak yang berhak memperoleh bagian warisan.

Hak tersebut diberikan sepanjang status perkawinan diakui secara hukum. Karena itu, dokumen pernikahan menjadi salah satu bukti penting dalam proses penetapan ahli waris.

2. Anak Kandung

Anak kandung, baik laki-laki maupun perempuan, merupakan ahli waris yang memiliki hak atas harta peninggalan orang tuanya.

Dalam sistem hukum nasional, anak-anak pada prinsipnya memperoleh kedudukan yang sama sebagai penerima warisan. Besaran bagian masing-masing dapat berbeda bergantung pada hukum yang digunakan dalam pembagian waris.

3. Anak Angkat Memiliki Ketentuan Khusus

Status anak angkat dalam perkara warisan memiliki pengaturan tersendiri.

Merujuk Pasal 174 ayat (1) Kompilasi Hukum Islam (KHI), anak angkat tidak termasuk ahli waris karena tidak memiliki hubungan darah maupun hubungan perkawinan dengan orang tua angkatnya.

Meski demikian, anak angkat tetap dapat memperoleh bagian melalui hibah atau wasiat dari orang tua angkat.

Bahkan, apabila tidak terdapat wasiat, Pasal 209 ayat (2) KHI mengatur bahwa anak angkat dapat menerima wasiat wajibah dengan nilai paling banyak sepertiga dari keseluruhan harta peninggalan.

Sementara itu, Pasal 1676 KUH Perdata juga menyebut bahwa seseorang pada dasarnya dapat memberikan atau menerima hibah selama tidak bertentangan dengan ketentuan hukum yang berlaku.

4. Orang Tua Kandung Pewaris

Ayah dan ibu kandung dapat menjadi ahli waris dalam kondisi tertentu, terutama apabila pewaris tidak meninggalkan anak.

Kedudukan orang tua sebagai penerima warisan telah diakui dalam berbagai sistem hukum yang berlaku di Indonesia.

5. Saudara Kandung

Saudara kandung juga berpotensi menjadi ahli waris apabila pewaris tidak memiliki keturunan maupun orang tua yang masih hidup.

Dalam situasi tersebut, hak waris dapat beralih kepada saudara laki-laki atau perempuan sesuai ketentuan hukum yang digunakan dalam pembagian harta peninggalan.

6. Pihak yang Ditunjuk melalui Wasiat

Seseorang dapat menunjuk pihak tertentu untuk menerima sebagian hartanya melalui wasiat yang dibuat secara sah menurut hukum.

Wasiat tersebut nantinya menjadi dasar dalam pembagian warisan, sepanjang pelaksanaannya tidak melanggar batasan yang telah ditetapkan dalam ketentuan perundang-undangan.

Dokumen yang Perlu Disiapkan untuk Mengurus Warisan Tanah

Setelah ahli waris ditetapkan, langkah berikutnya adalah mengurus peralihan hak atas tanah di kantor pertanahan.

Agar proses administrasi berjalan lancar, sejumlah dokumen perlu dipersiapkan, antara lain:
• Surat Keterangan Waris (SKW)
• Kartu identitas para ahli waris
• Surat kematian pewaris
• Sertifikat tanah asli
• Dokumen pendukung lainnya sesuai kebutuhan

Kelengkapan berkas menjadi faktor penting agar proses pengajuan tidak mengalami kendala.

Cara Balik Nama Sertifikat Tanah Warisan

Setelah seluruh dokumen siap, ahli waris dapat mengajukan permohonan balik nama sertifikat tanah melalui tahapan berikut:

1. Mengajukan Permohonan ke Kantor Pertanahan

Pemohon mendatangi Kantor Pertanahan sesuai lokasi tanah berada untuk mengisi formulir serta menyerahkan dokumen yang dipersyaratkan.

2. Pemeriksaan Berkas
Petugas akan melakukan verifikasi terhadap seluruh dokumen yang diajukan guna memastikan keabsahan data pemohon maupun objek tanah.

3. Membayar BPHTB
Dalam kondisi tertentu, ahli waris diwajibkan melunasi Bea Perolehan Hak atas Tanah dan Bangunan (BPHTB) sesuai ketentuan yang berlaku.

4. Verifikasi oleh BPN
Setelah berkas dinyatakan lengkap, Badan Pertanahan Nasional (BPN) akan melakukan pemeriksaan lanjutan terhadap data yuridis dan administrasi pertanahan.

5. Penerbitan Sertifikat Baru
Apabila seluruh tahapan telah selesai, sertifikat tanah akan diterbitkan atas nama ahli waris yang berhak sesuai hasil pembagian warisan.

Sebagaimana diketahui, memahami siapa saja yang berhak menerima warisan tanah bukan sekadar persoalan administrasi.

Pengetahuan ini juga menjadi langkah awal untuk mencegah konflik keluarga yang kerap muncul akibat perbedaan tafsir mengenai hak waris.
